Toyota has lost a bid to trade mark the shape of its 'spindle grille', which features on models in its Lexus division, despite a finding it was used and heavily promoted in Australia for years. In a decision handed down last month, IP Australia delegate Katrina Brown rejected Toyota's 2020 application to trade mark the pinched trapezoid shape of its Lexus car grille - finding the shape was not invented by Toyota, and not capable of being distinguished from similar shapes used by other car makers.
